This calculator is an informational aid based on New York’s SORA Risk Assessment Instrument and Guidelines (“RAI”) which were published in 2006 and have been treated as legally binding by the New York Courts. The risk assessment is a legal determination and only a licensed New York lawyer can provide legal advice. The RAI has been widely criticized by advocates of all political stripes: it is both ambiguous and predictably inaccurate. A proposal is pending in the New York State legislature to abolish it’s use. This calculator is not a substitute for legal advice and cannot accurately determine a person’s risk level. The score and presumptive level may not reflect disputed evidence, legal arguments, or a court’s final determination. Under the Guidelines a court may depart upwardly or downwardly.
